Terms of Service

You must be at least 13 years old to create an account. If you are under 18, you may only use XploreScene with the consent of a parent or legal guardian. Some experiences listed on the Service (for example, venues that serve alcohol) may have their own age requirements set by the business or venue, which you are responsible for meeting independently of your XploreScene account.

Business accounts are subject to additional terms in Section 6 below.

XploreScene helps you discover local experiences, coordinate plans with friends, and get AI-assisted recommendations. Some experiences shown in the app are listed directly by business owners; others are pulled from third-party sources (currently Eventbrite, Ticketmaster, and Viator) to broaden what you can discover. XploreScene does not itself organize, operate, or guarantee any experience — see Section 5.

You're responsible for the accuracy of the information you provide and for keeping your account credentials secure. You're responsible for activity that happens under your account.

If you create a business listing, you retain ownership of the photos, videos, and descriptions you upload. By uploading them, you grant XploreScene a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content within the Service (including on the feed, map, and group plan features) for the purpose of operating and promoting XploreScene. You confirm you have the rights to upload what you upload, and that it doesn't infringe anyone else's rights.

You agree not to use the Service to:

• Post content that is illegal, fraudulent, harassing, or infringes someone else’s rights
• Impersonate another person or business, or misrepresent a listing
• Scrape, reverse-engineer, or interfere with the Service or its infrastructure
• Use the Vibes AI assistant to generate content that violates these Terms
• Attempt to circumvent booking, payment, or fee systems

Group Plans, friend connections, and direct/group messages let you coordinate with other users. Content you share in a plan or message is visible to the other members of that plan or conversation, and is stored on our servers to enable that functionality (see our Privacy Policy). Be respectful — harassment or abuse of other users can result in suspension or termination of your account.

When you book a paid experience listed directly by a business on XploreScene, XploreScene facilitates the transaction — collecting payment via Stripe on the business's behalf — but the contract for the experience itself is between you and that business, not XploreScene. XploreScene does not store your full payment card details. The business owner sets their own pricing, capacity, and refund policy for each listing (shown at checkout) — refunds, cancellations, and no-shows for that booking are governed by the business's stated policy, not by XploreScene.

Experiences sourced from Eventbrite, Ticketmaster, or Viator are booked through those platforms directly; XploreScene is not a party to that transaction and is not responsible for it.

XploreScene is a discovery and coordination platform, not the operator, organizer, or supplier of any experience. Businesses listing experiences are independent third parties, not agents or employees of XploreScene. We don't vet, endorse, or guarantee the conduct, safety, legality, or quality of any experience, venue, or business listed on the Service, and we're not responsible for injury, loss, or damage arising from your participation in one. You participate in any experience at your own risk.

If you list experiences as a business owner, you represent that you have the legal right and any required licenses or permits to offer what you list, and that your listings are accurate. You're responsible for honoring bookings made through your listings, and for connecting a valid Stripe account to receive payment. XploreScene charges a platform fee on paid bookings, deducted automatically through Stripe Connect; the current fee is disclosed in your business settings.

The Vibes assistant uses a third-party AI model to interpret your messages and suggest experiences or help build group plans. Responses are generated automatically and may occasionally be inaccurate or unavailable — don't rely on Vibes as your only source for time-sensitive or safety-critical information (e.g., whether a venue is currently open).

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or for any other reason at our discretion, with notice where practical.

The Service is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, XploreScene disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement, and is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service or any experience booked through it — including damages arising from the acts, omissions, or negligence of any business, venue, or third-party platform.

If XploreScene is found liable for any claim arising from your use of the Service, our total liability is limited to the greater of (a) the amount you paid to XploreScene (not to third-party businesses or platforms) in the 12 months before the claim arose, or (b) $100. This limitation doesn't apply where prohibited by law.

You agree to defend and indemnify XploreScene against any claims, losses, or expenses (including reasonable legal fees) arising from: your breach of these Terms; your violation of any law or third party's rights; content you post or upload; or your participation in any experience booked through the Service.

We may update these Terms from time to time. If we make material changes, we'll notify you in the app or by email before they take effect. Continuing to use XploreScene after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. [Placeholder — confirm jurisdiction and add a dispute resolution/arbitration clause with counsel before publishing.]
